Ch. 2004-473 (C.S. for S.B. 4-A)  Affects provisions relating to the apportionment of certain costs and funding for juvenile detention facilities. Effective December 21, 2004, except as otherwise provided.

Ch. 2004-474 (C.S. for S.B. 8-A)  Establishes reimbursement procedures for ad valorem taxes levied on certain residential property rendered uninhabitable due to a named tropical system; prescribes reimbursement procedures for sales taxes paid on replacement mobile homes purchased as a result of damage caused by a named tropical system. Effective December 21, 2004.

Ch. 2004-475 (C.S. for S.B. 14-A)  Provides appropriations for the repair and restoration of state beaches and dunes adversely affected by specified 2004 hurricanes and tropical storms; requires a progress report. Effective December 21, 2004.

Ch. 2004-476 (S.B. 16-A)  Provides appropriations for activities relating to citrus canker eradication and tree compensation, soybean rust control, and the Caribbean fruit fly certification program; requires a progress report on the eradication of citrus canker. Effective December 21, 2004.

Ch. 2004-477 (S.B. 18-A)  Provides appropriations to address nutritional, medical, and social service needs of the elderly, children, families, disabled, and low-income individuals adversely affected by specified 2004 hurricanes and tropical storms. Effective December 21, 2004.

Ch. 2004-478 (S.B. 28-A)  Revises income documentation requirements for eligibility for the Florida Kidcare program. Effective December 21, 2004.

Ch. 2004-479 (H.B. 5-A)  Delays the date by which discount medical plan organizations or plan marketers must comply with specified licensure and regulation provisions. Effective December 21, 2004.

Ch. 2004-480 (H.B. 9-A)  Affects provisions relating to hurricane insurance deductibles; prescribes reimbursement and applicability policies and procedures. Effective December 21, 2004.

Ch. 2004-481 (H.B. 11-A)  Establishes an Educational Facilities Hurricane Restoration Cash Flow Loan Program to restore educational facilities damaged by hurricanes in 2004; provides eligibility requirements. Effective December 21, 2004.

Ch. 2004-482 (H.B. 19-A)  Affects provisions relating to hurricane-relief funding. Effective December 21, 2004, except as otherwise provided.

Ch. 2004-483 (H.B. 21-A)  Requires the Agency for Workforce Innovation to provide quarterly reports on certain expenditures. Effective December 21, 2004.

Regular Session of the Florida Legislature

Ch. 2005-1 (S.B. 1334)  Designates portions of the Florida Statutes 2005 which constitute the official statute law of the state. Designates general laws which are, and which are not, repealed by the adoption of the Florida Statutes 2005. Effective July 5, 2005.

Ch. 2005-2 (C.S. for S.B. 1336)  Amends, repeals, or reenacts various provisions in the Florida Statutes to replace incorrect cross-references, delete obsolete or expired provisions, correct grammatical and typographical errors, remove inconsistencies and redundancies, and otherwise improve the clarity of the statutes. Effective July 5, 2005.

Ch. 2005-3 (S.B. 1338)  Repeals numerous provisions of the Florida Statutes which were repealed other than by a “current session” of the Legislature, for the purpose of omitting such provisions from publication in the Florida Statutes 2005. Effective July 5, 2005.

Ch. 2005-4 (S.B. 1340)  Removes gender-specific references to human beings from the Florida Statutes without substantive change in legal effect. Effective July 5, 2005.

Ch. 2005-5 (C.S. for S.B. 200)  Redesignates the “Florida Hazardous Materials Emergency Response and Community Right-to-Know Act of 1988” as the “Florida Emergency Planning and Community Right-to-Know Act”; extends the date of certain fee provisions. Effective July 1, 2005.

Ch. 2005-6 (S.B. 516)  Revises provisions relating to citrus districts; membership of the Florida Citrus Commission; and the Citrus Stabilization Act. Effective July 1, 2005.

Ch. 2005-7 (S.B. 1376)  Re-creates the Dedicated License Trust Fund; carries forward all current balances of the fund; and continues all current sources and uses of the fund. Effective November 4, 2008.

Ch. 2005-8 (S.B. 1378)  Re-creates the Florida Panther Research and Management Trust Fund; carries forward all current balances of the fund; and continues all current sources and uses of the fund. Effective November 4, 2008.

Ch. 2005-9 (S.B. 1380)  Re-creates the Florida Forever Program Trust Fund; carries forward all current balances of the fund; and continues all current sources and uses of the fund. Effective July 1, 2008.

Ch. 2005-16 (S.B. 1394)  Re-creates the Conservation and Recreation Lands Program Trust Fund within the Fish and Wildlife Conservation Commission; carries forward all current balances of the fund; and continues all current sources and uses of the fund. Effective July 1, 2008.

Ch. 2005-17 (C.S. for S.B. 1396)  Terminates the Florida Preservation 2000 Trust Fund and the Federal Law Enforcement Trust Fund within the Fish and Wildlife Conservation Commission; provides for transfer of current balances and revenues to trust funds within the commission. Effective July 1, 2005.

Ch. 2005-27 (C.S. for C.S. for S.B. 436)  Authorizes the use of force, including deadly force, against an intruder or attacker in a dwelling, residence, or occupied vehicle under specified circumstances; provides exceptions; conforms specified provisions. Provides immunity from criminal prosecution and civil action for justifiable use of force. Effective October 1, 2005.

Ch. 2005-28 (H.B. 1877)  Affects provisions relating to sexual predators and offenders. Effective September 1, 2005.

Ch. 2005-29 (H.B. 155)  Provides legislative findings regarding implementation and funding of the Lake Okeechobee Watershed Phosphorous Control Program and the Lake Okeechobee Protection Program; redefines a specified term. Effective July 1, 2005.

Ch. 2005-30 (H.B. 213)  Requires the Board of Architecture and Interior Design and the Board of Landscape Architecture to prescribe forms of seals to be used by holders of valid certificates of registration; authorizes certain electronic registrations and transmissions; conforms specified provisions; revises certain contracting provisions. Effective July 1, 2005.

Ch. 2005-31 (H.B. 281)  Requires establishment of a Paper Reduction Task Force to recommend paperwork reduction strategies for school districts and their personnel; provides for membership and requires a report. Effective May 10, 2005.

Ch. 2005-32 (H.B. 349)  Revises auditor selection procedures. Effective July 1, 2005.

Ch. 2005-33 (H.B. 411)  Adds the offenses of possession of any photographic material containing sexual conduct of a minor, transmission of pornography by electronic device, and facilitation of sexual conduct of or with a minor or the visual depiction of such conduct to the Criminal Punishment Code; reclassifies the offense of solicitation of a child, via a computer service, to commit an unlawful sexual act. Effective July 1, 2005.

Ch. 2005-34 (H.B. 625)  Transfers a provision relating to a county’s authority to close and abandon certain roads and rights-of-way; conforms a specified provision. Effective May 10, 2005.

Ch. 2005-35 (H.B. 655)  Expands the powers and duties of the Florida Inland Navigation District. Effective July 1, 2005.

Ch. 2005-36 (H.B. 727)  Revises water management district planning and reporting requirements; repeals a provision relating to groundwater basin resource availability inventories. Effective July 1, 2005.

Ch. 2005-37 (H.B. 1923)  Revises and readopts an exemption from public records requirements for specified proprietary confidential business information held by a local governmental entity. Effective September 30, 2005.

Ch. 2005-38 (S.B. 574)  Designates the orange as the official state fruit. Effective May 20, 2005.

Ch. 2005-39 (H.B. 1283)  Affects provisions relating to paternity, child support, and noncovered medical expenses. Effective July 1, 2005, except as otherwise provided.

Ch. 2005-40 (H.C.B. 6001)  Exempts certain goods from sales and use tax application for a specified time period. Effective May 23, 2005.

Ch. 2005-41 (S.B. 450)  Provides that certain motor vehicle insurance rate increases for insureds in active military service and their covered dependents constitute unfair practices. Effective May 24, 2005.

Ch. 2005-42 (S.B. 550)  Revises qualifications for property tax exemptions for certain surviving spouses of disabled ex-service members; defines the term “ex-service member.” Effective July 1, 2005.

Ch. 2005-43 (S.B. 868)  Creates the “Ellwood Robinson ‘Bob’ Pipping, Jr., Memorial Act”; authorizes the establishment of certain monuments and memorials honoring Florida’s military veterans. Effective May 24, 2005.

Ch. 2005-44 (H.B. 285)  Authorizes the state attorney to file a demand for a speedy trial under certain circumstances; requires the trial court to schedule the trial within a prescribed time period; provides for extensions and postponements under certain conditions. Effective July 1, 2005.

Ch. 2005-45 (H.B. 395)  Provides for a military gold sportsman’s license; provides for an annual fee and use of funds; prescribes licensure eligibility and authorizations; provides an exemption; conforms specified provisions. Effective May 24, 2005.

Ch. 2005-46 (H.B. 523)  Provides an exception to the hearsay rule of evidence for a statement of a deceased or ill declarant similar to one previously admitted; repeals a provision relating to testimony of an interested person regarding certain oral communications. Effective July 1, 2005.

Ch. 2005-47 (H.B. 623)  Exempts former military vehicles from certain motor vehicle windshield and license plate requirements; defines the term “former military vehicle”; requires eye-protective devices when such vehicles are in operation. Effective July 1, 2005.

Ch. 2005-48 (H.B. 691)  Creates the Citizen Soldier Matching Grant Program; provides for grant awards to private sector employers that provide wages to certain service members on federal active duty; mandates that professional licenses of service members not expire while such members are on federal active duty; provides for an extension period. Effective July 1, 2005.

Ch. 2005-49 (H.B. 885)  Increases the number of regional autism centers; changes service providers for certain counties; directs specified fundraising efforts; prohibits future direct medical and pharmaceutical intervention in a center. Effective May 24, 2005.

Ch. 2005-50 (H.B. 937)  Requires notification of contamination which extends beyond the rehabilitation site property boundaries; prescribes notice format and procedures; defines specified terms. Effective September 1, 2005.

Ch. 2005-51 (H.B. 1069)  Creates the Family Readiness Program to provide need-based assistance to families of specified service members who are federally deployed or participating in homeland defense; provides for program funding, participant eligibility, and award procedures. Effective July 1, 2005.

Ch. 2005-52 (H.B. 1659)  Creates the Parental Notice of Abortion Act; provides notice criteria and procedures; provides for a waiver; penalizes violations; defines specified terms. Effective upon the adoption of rules and forms by the Supreme Court, but no later than July 1, 2005.

Ch. 2005-53 (S.B. 288)  Revises and readopts an exemption from public records requirements for seaport security plans. Effective October 1, 2005.

Ch. 2005-54 (C.S. for C.S. for S.B. 334)  Authorizes the Florida Housing Finance Corporation to waive annual recertification under certain conditions; revises provisions relating to revitalization of blighted areas and the powers and limitations on a housing authority; repeals certain limitations on housing authorities in Orange and Seminole Counties. Effective May 26, 2005.

Ch. 2005-55 (S.B. 356)  Revises provisions relating to substance abuse treatment; conforms specified provisions. Effective July 1, 2005.

Ch. 2005-56 (C.S. for S.B. 388)  Revises provisions relating to education funding; revises a provision relating to early learning coalitions; repeals a provision relating to K-20 education performance-based funding and the BEST Florida Teaching salary career ladder program. Effective July 1, 2005.

Ch. 2005-57 (C.S. for S.B. 392)  Permits the use of funds from the Water Quality Assurance Trust Fund for the administration of brownfield sites. Effective July 1, 2005.

Ch. 2005-58 (C.S. for S.B. 394)  Requires that funding for the enforcement of farm labor laws be provided via a transfer of funds from the Workers’ Compensation Administration Trust Fund to the Professional Regulation Trust Fund. Effective July 1, 2005.

Ch. 2005-59 (C.S. for S.B. 400)  Requires compensation of a provider for contracted on-line procurement; provides for payment and deposit of certain fees due to the state. Effective July 1, 2005.

Ch. 2005-60 (C.S. for C.S. for S.B. 404)  Creates and revises various provisions relating to health care; repeals a provision establishing the Office of Long-Term Care Policy; provides for future repeal of a specified pharmaceutical expense assistance program. Effective July 1, 2005, except as otherwise provided.

Ch. 2005-61 (C.S. for S.B. 408)  Revises provisions relating to economic eligibility services; repeals a provision relating to eligibility determination functions of the Economic Self-Sufficiency Services Program. Effective July 1, 2005.

Ch. 2005-62 (C.S. for S.B. 410)  Revises certain health care professional licensure, examination, and certification provisions; includes specified information relating to liability and disciplinary actions in a practitioner profile. Effective July 1, 2005.

Ch. 2005-63 (C.S. for C.S. for S.B. 434)  Revises provisions relating to accommodations for individuals with disabilities, including provisions relating to service animals; conforms specified provisions. Effective July 1, 2005.

Ch. 2005-64 (S.B. 538)  Clarifies that prosecutors may introduce and argue victim impact evidence to the jury. Effective July 1, 2005.

Ch. 2005-65 (C.S. for C.S. for S.B. 1090)  Creates and revises provisions relating to disclosure of medical information, administration of specified medications, and informed patient consent regarding mental health care for minors and incapacitated persons. Effective July 1, 2005.

Ch. 2005-66 (C.S. for S.B. 1154)  Revises provisions relating to Enterprise Florida, Inc.; repeals a provisions relating to the International Trade Data Resource and Research Center. Effective May 26, 2005.

Ch. 2005-67 (C.S. for S.B. 1354)  Prohibits certain convicted sex offenders who are subject to conditional release supervision from having contact with a child under 18 years of age; provides a limited exception; conforms specified provisions. Effective January 1, 2006.

Ch. 2005-68 (S.B. 1502)  Requires that the driver’s license application form include language permitting a voluntary contribution to the Children’s Hearing Help Fund; exempts such funds from the general revenue service charge. Effective July 1, 2005.

Ch. 2005-69 (C.S. for S.B. 2278)  Revises provisions relating to the types of firearms a licensed security officer, private investigator, or recovery agent may carry while performing authorized duties. Effective July 1, 2005.

Ch. 2005-70 (S.B. 2600)  General Appropriations Act; provides appropriations for fiscal year 2005-2006. Effective July 1, 2005, except as otherwise provided.

Ch. 2005-71 (S.B. 2602)  Provides implementing and administering provisions for the General Appropriations Act for fiscal year 2005-2006. Effective July 1, 2005, except as otherwise provided.

Ch. 2005-72 (H.B. 19)  Enumerates specified licensure reinstatement prerequisites and insurance coverage requirements for certain persons whose driver’s license or vehicle registration has been suspended or revoked; mandates that insurers make specified noncancelable coverage available for a certain period of time; permits cancellation under certain circumstances. Effective October 1, 2005.

Ch. 2005-73 (H.B. 227)  Requires that district school boards develop plans to sponsor summer nutrition programs; provides criteria; provides for exemption under certain conditions. Effective July 1, 2005.

Ch. 2005-74 (H.B. 255)  Revises certain animal rabies vaccination and certification requirements. Effective January 1, 2006.

Ch. 2005-75 (H.B. 279)  Authorizes specified K-12 students to possess and self-administer epinephrine by auto-injector under certain circumstances; provides for indemnification. Effective January 1, 2006.

Ch. 2005-76 (H.B. 307)  Authorizes certain physician assistants and advanced nurse practitioners to conduct physical examinations of specified licensure and employment applicants. Effective July 1, 2005.

Ch. 2005-77 (H.B. 319)  Reclassifies penalties for offenses committed on the property of a religious institution while the victim is present to attend or participate in a religious service; conforms a specified provision. Effective July 1, 2005.

Ch. 2005-78 (H.B. 423)  Redefines the term “employee” under the Workers’ Compensation Law to revise an exemption relating to owner-operators of motor vehicles. Effective July 1, 2005.

Ch. 2005-79 (H.B. 565)  Revises provisions relating to pre-mediation disclosures and meetings between mobile home park owners and homeowners’ committees; provides sovereign immunity for specified agents or employees and board members or representatives. Effective May 26, 2005.

Ch. 2005-80 (H.B. 577)  Revises the Interstate Compact for Juveniles; provides for an Interstate Commission for Juveniles; provides for commission membership, powers, duties, organization, and operation; repeals former compact provisions which have been superseded. Effective July 1, 2005, or upon enactment of the compact into law by the 35th compacting state, whichever date occurs later.

Ch. 2005-81 (H.B. 763)  Exempts critical access hospitals from certain medical treatment facility requirements under specified circumstances; redefines specified terms; conforms specified provisions. Effective July 1, 2005.

Ch. 2005-82 (H.B. 775)  Revises provisions relating to child support enforcement. Effective May 26, 2005, except as otherwise provided.

Ch. 2005-83 (H.B. 805)  Abrogates the repeal of an exemption for solar energy systems from the tax on sales, use, and other transactions. Effective May 26, 2005.

Ch. 2005-84 (H.B. 841)  Provides for the deposit of a percentage of unclaimed prize money and a percentage of revenues from the sale of certain lottery tickets in the Educational Enhancement Trust Fund; revises provisions relating to allocation and expenditure of funds for public education. Effective July 1, 2005.

Ch. 2005-85 (H.B. 897)  Expands the definition of security accounts; creates and revises provisions relating to trusts. Effective July 1, 2005.

Ch. 2005-86 (H.B. 951)  Revises provisions relating to the Florida Small Cities Community Development Block Grant Program. Effective July 1, 2005.

Ch. 2005-87 (H.B. 1141)  Creates and revises provisions relating to greenways and trails. Effective May 26, 2005.

Ch. 2005-88 (H.B. 1695)  Provides an exemption from public records requirements for individual records of children enrolled in the Voluntary Prekindergarten Education Program; provides exceptions; provides for future review and repeal. Effective May 26, 2005.

Ch. 2005-89 (H.B. 1699)  Revises and readopts an exemption from public records requirements for specified information provided to sheriffs or state attorneys in certain domestic violence cases. Effective May 26, 2005.

Ch. 2005-90 (H.B. 1765)  Creates the Federal Grants Trust Fund within the Florida Parole Commission; provides for source and use of funds; provides for review and termination or re-creation. Effective July 1, 2005.

Ch. 2005-91 (H.B. 1817)  Revises and readopts an exemption from public records requirements relating to an active investigation or office review of a certified capital company; eliminates the exemption for specified persons. Effective May 26, 2005.

Ch. 2005-92 (H.B. 1889)  Revises provisions relating to the distribution of funds from the excise tax on documents. Effective July 1, 2007, except as otherwise provided.

Ch. 2005-93 (H.B. 1907)  Revises specified payroll contribution rates for the Florida Retirement System and the Institute of Food and Agricultural Sciences; reduces the administrative and educational assessments paid to the State Board of Administration. Effective July 1, 2005.

Ch. 2005-94 (H.B. 105)  Provides that a certificate of authority is not required of certain insurers domiciled outside the United States for specified life insurance policies or annuity contracts; provides criteria, requirements, and limitations; requires certain disclosures. Effective July 1, 2005.

Ch. 2005-95 (H.B. 1041)  Creates the Women’s Health and Safety Act; prescribes rule requirements relating to abortion clinics. Effective July 1, 2005.

Ch. 2005-96 (S.B. 300)  Abrogates the expiration of certain provisions relating to taxation. Effective July 1, 2005.

Ch. 2005-97 (C.S. for S.B. 424)  Provides for the resolution of specified collective bargaining issues; creates and revises provisions relating to certain state group health insurance programs. Effective June 1, 2005.

Ch. 2005-98 (C.S. for S.B. 478)  Requires annual reporting by a hospital with a podiatric residency program; expands the time period a resident in such program may continue unlicensed; specifies conditions under which a resident may prescribe medicinal drugs; penalizes violations. Effective July 1, 2005.

Ch. 2005-99 (C.S. for S.B. 552)  Provides that certain operators of game promotions in connection with the sale of consumer products or services are required to include only specified information in advertising copy under certain conditions. Effective July 1, 2005.

Ch. 2005-100 (C.S. for S.B. 656)  Revises and reenacts provisions relating to benefits and death benefits for and disciplinary actions against law enforcement and correctional officers. Effective July 1, 2005.

Ch. 2005-101 (C.S. for S.B. 660)  Revises provisions relating to assets held in various benefit plans. Effective June 1, 2005.

Ch. 2005-102 (S.B. 724)  Increases the loan cap amount available to sponsors of housing communities for the elderly. Effective July 1, 2005.

Ch. 2005-103 (C.S. for S.B. 738)  Revises provisions relating to the appointment of members to the Criminal Justice Standards and Training Commission. Effective June 1, 2005.

Ch. 2005-104 (C.S. for S.B. 798)  Provides an exemption from public records requirements for records held by a circuit or appellate court relating to a minor’s petition to waive notice requirements when terminating a pregnancy. Provides for future review and repeal. Effective upon the adoption of rules and forms by the Supreme Court, but no later than July 1, 2005.

Ch. 2005-105 (S.B. 904)  Exempts a lead community-based foster care and related services provider from including specified language or a specified logo in its written contracts or documents; provides an exception. Effective June 1, 2005.

Ch. 2005-106 (S.B. 908)  Clarifies the Department of Environmental Protection’s rulemaking authority and the requirements and responsibilities of local governments regarding the Wekiva Parkway and Protection Act. Effective June 1, 2005.

Ch. 2005-107 (C.S. for C.S. for C.S. for S.B. 1366)  Provides for storm infrastructure recovery; clarifies the powers and duties of the Public Service Commission regarding the infrastructure recovery process; defines specified terms. Effective June 1, 2005.

Ch. 2005-108 (C.S. for S.B. 1368)  Creates the “Florida Uniform Disclaimer of Property Interests Act”; conforms specified provisions. Repeals provisions relating to disclaimer of interests in property passing under certain nontestamentary instruments or certain powers of appointment and disclaimer of interests in property passing by will or intestate succession or under certain powers of appointment. Effective July 1, 2005.

Ch. 2005-109 (C.S. for S.B. 1436)  Provides for the purchase of automated external defibrillators by local governments; authorizes the carrying and use of such defibrillators in state and local law enforcement vehicles. Effective July 1, 2005.

Ch. 2005-112 (S.B. 1798)  Provides for the adoption of the 2005 version of the Internal Revenue Code. Effective June 1, 2005, and retroactively operative to January 1, 2005.

Ch. 2005-113 (S.B. 1980)  Expands the Florida Commission on Tourism membership to include a member of the restaurant industry; requires that all members file financial disclosures; repeals a provision relating to a statewide advisory committee. Effective July 1, 2005.

Ch. 2005-114 (C.S. for S.B. 2196)  Creates the Shared County/State Juvenile Detention Trust Fund within the Department of Juvenile Justice; provides for use and source of funds; provides for review and termination or re-creation. Effective July 1, 2005.

Ch. 2005-115 (H.B. 17)  Requires the Agency for Health Care Administration (AHCA) in conjunction with the Agency for Persons with Disabilities to develop a model home and community-based waiver to serve children with specified disorders; requires AHCA to seek federal waiver approval and to implement the waiver. Effective July 1, 2005.

Ch. 2005-116 (H.B. 41)  Provides criminal penalties for the unlicensed intentional or willful installation, service, testing, repair, improvement, or inspection of a fire alarm system; provides an exemption. Effective October 1, 2005.

Ch. 2005-118 (H.B. 151)  Redefines the term “low-income” to expand a poverty level family income criterion. Effective July 1, 2005.

Ch. 2005-119 (H.B. 233)  Enhances the criminal penalties for the unlawful killing of an unborn quick child by injury to the child’s mother; includes such crime under DUI manslaughter; conforms specified provisions; adopts a certain definition. Effective October 1, 2005.

Ch. 2005-120 (H.B. 345)  Revises the powers and duties of the Capitol Police; revises a provision relating to enforcement of traffic laws. Effective July 1, 2005.

Ch. 2005-121 (H.B. 473)  Mandates that certain water management districts conduct fingerprint-based criminal history checks of current or prospective employees or designated persons; permits other such districts to conduct these checks; establishes check requirements and procedures. Effective June 1, 2005.

Ch. 2005-122 (H.B. 531)  Provides for the issuance of a certificate of release for a mortgage by a title insurer for certain purposes; prescribes release certificate contents, procedures, and recordation; provides for liability of title insurers under certain circumstances; repeals a provision relating to failure or refusal to satisfy a lien. Effective July 1, 2005.

Ch. 2005-123 (H.B. 569)  Permits year-round enrollment in the Medikids and Florida KidCare programs; provides a time period for the validity of KidCare program application. Effective June 1, 2005.

Ch. 2005-124 (H.B. 699)  Makes certain provisions on architectural and interior design services certifications applicable to limited liability companies; requires the Board of Architecture and Interior Design and the Board of Landscape Architecture to prescribe forms of seals to be used by holders of valid certificates of registration; authorizes certain electronic registrations and transmissions; requires surrender of seal upon registration expiration, suspension, or revocation; revises disciplinary actions and procedures. Effective June 1, 2005.

Ch. 2005-125 (H.B. 853)  Requires that a motor vehicle retail lessor provide a copy of the lease agreement to the retail lessee. Effective June 1, 2005.

Ch. 2005-126 (H.B. 871)  Provides additional authorization for the deposit of surplus state and local government funds; exempts certain public deposits from security requirements. Effective July 1, 2005.

Ch. 2005-136 (S.B. 266)  Removes the time limitation from an alternative method by which state-designated teaching nursing homes and certain affiliated assisted living facilities may demonstrate financial responsibility. Effective June 3, 2005.

Ch. 2005-137 (C.S. for C.S. for S.B. 492)  Affects provisions relating to recovering, towing, and storage of motor vehicles, vessels, and mobile homes. Effective July 1, 2005, except as otherwise provided.

Ch. 2005-138 (C.S. for S.B. 530)  Mandates installation of specified ignition interlock devices on all vehicles owned or leased and operated by persons convicted of certain driving-under-the-influence offenses, prior to issuance of permanent or restricted drivers’ licenses; provides exceptions; prescribes installation period duration. Ch. 2005-183 (C.S. for S.B. 1454)  Prohibits unauthorized handbill distribution in a public lodging establishment; penalizes violations; requires that such lodging establishments provide notification of the prohibition. Effective July 1, 2005.

Ch. 2005-184 (C.S. for S.B. 1602)  Prescribes the burden of proof, remedy, and affirmative defense in certain tax refund or recovery actions. Ch. 2005-191 (H.B. 189)  Mandates that construction standards for hospice facilities comply with the Florida Building Code; provides for an update of the construction standards for such facilities. Effective July 1, 2005.

Ch. 2005-192 (H.B. 291)  Imputes actions taken by a developer designated board of administration of a condominium association to the developer; requires examination and certification of certain defects by specified licensed individuals or entities. Effective July 1, 2005.

Ch. 2005-193 (H.B. 449)  Expands the public records exemption for proprietary confidential business information regarding trade secrets owned or controlled by the not-for-profit corporation operating the H. Ch. 2005-194 (H.B. 497)  Requires traffic citation forms to include a check box indicating failure to stop at a traffic signal; provides penalties for such failure; provides for distribution of funds collected as fines. Effective October 1, 2005.

Ch. 2005-212 (H.B. 1921)  Revises and readopts an exemption from public records requirements for certain information obtained by a domestic violence fatality review team; revises and readopts an exemption from public meetings requirements for specified portions of meetings held by any domestic violence fatality review team. Ch. 2005-213 (C.S. for S.B. 1098)  Provides an exemption from public records requirements for specified information held by or regarding a guardian ad litem; creates an exception to the exemption for all records held by the Department of Children and Family Services regarding reports of child abandonment, abuse, or neglect; provides for future review and repeal. Ch. 2005-245 (S.B. 498)  Requires that the Department of Children and Family Services or a community-based care provider determine citizenship or residency status of immigrant children who have been adjudicated dependent; provides for services and prescribes development of case plans and department or provider responsibilities. Ch. 2005-246 (C.S. for S.B. 512)  Specifies the evidentiary requirements for a protective injunction filed on behalf of a minor child. Effective June 17, 2005.

Ch. 2005-247 (S.B. 670)  Revises specified community college student fee provisions; provides requirements for bond issuance and validation; revises the maximum capital improvement fee allocation for community college child care centers. Effective July 1, 2005.

Ch. 2005-248 (C.S. for C.S. for S.B. 874)  Excludes the transfer of prescription drugs due to a change in pharmacy ownership from the definition of “wholesale distribution”; redefines the term “pedigree paper” and abrogates the repeal of recordkeeping provisions for such papers; prohibits the use of specified violations as grounds for denying or withholding certain Medicaid reimbursements. Effective June 17, 2005.

Ch. 2005-249 (C.S. for S.B. 1012)  Provides for the reinstatement of certain voided licenses; prescribes reinstatement requirements. Effective July 1, 2005.

Ch. 2005-250 (C.S. for C.S. for S.B. 1114)  Permits certain restaurant patrons to remove resealed wine containers from the restaurant for off-premise consumption; specifies circumstances and procedures; clarifies that such resealed container is not an open container. Effective July 1, 2005.

Ch. 2005-251 (C.S. for S.B. 1144)  Revises and reorganizes certain public records and public meetings exemption provisions. Effective October 1, 2005.

Ch. 2005-252 (C.S. for S.B. 1208)  Provides for the establishment of the Florida Long-Term Care Partnership Program; provides program purpose and duties; provides for reduction in the total countable assets of certain persons when determining eligibility for nursing and rehabilitative services. Ch. 2005-253 (C.S. for C.S. for S.B. 1446)  Permits the State Board of Administration to require evidence of termination of employment; revises provisions relating to certain optional retirement programs; authorizes investment in additional asset-backed securities. Effective July 1, 2005.

Ch. 2005-254 (S.B. 1460)  Requires that the motor vehicle registration application form include language permitting a voluntary contribution to Southeastern Guide Dogs, Inc.; provides for use of funds; exempts such funds from the general revenue service charge. Effective July 1, 2005.

Ch. 2005-256 (C.S. for S.B. 1868)  Extends the moratorium on approving additional off-premise hospital emergency departments; revises provisions relating to regional poison control center certification and such centers’ access to and disclosure of certain patient information. Ch. 2005-257 (C.S. for C.S. for S.B. 1912)  Creates, revises, and repeals provisions relating to licensure, registration, resident status, discipline, and reporting requirements of insurance agents and agencies. Effective October 1, 2005.

Ch. 2005-258 (C.S. for S.B. 2006)  Revises provisions relating to motor vehicle service agreements and service warranties. Effective July 1, 2005.

Ch. 2005-259 (H.B. 77)  Requires specified utilities and cooperatives to offer a purchase contract to producers of renewable energy; provides for establishment of purchase and contract requirements and rules; revises waste-to-energy facility permitting requirements and encourages certain permit applicants to consider construction of such facilities. Effective October 1, 2005.

Ch. 2005-260 (H.B. 925)  Requires motorists to stop and yield to mobility-impaired pedestrians assisted by guide dogs or service animals. Effective July 1, 2005.

Ch. 2005-261 (H.B. 1029)  Requires the Florida Seaport Transportation and Economic Development Council to establish a matching funds program for certain dredging projects. Effective July 1, 2005.

Ch. 2005-262 (H.B. 1651)  Excludes specified chiropractic clinical facilities from the definition of the term “clinic” in regards to the Health Care Clinic Act; provides a regulation exception for chiropractic students participating in chiropractic college clinical internships; defines a specified term. Effective June 17, 2005.

Ch. 2005-263 (H.B. 1917)  Revises provisions relating to residential and nonresidential commitment, detention, and treatment programs for children in the juvenile justice system; redefines specified terms; conforms specified provisions; repeals a certain task force on juvenile sexual offenders and provides for creation of a new task force on the subject. Effective July 1, 2005.

Ch. 2005-264 (H.B. 1939)  Provides an exemption from public records requirements for certain reports of hurricane loss data and associated exposure data specific to a particular insurance company; provides an exemption from public meetings requirements for portions of meetings held by the Florida Commission on Hurricane Loss Projection Methodology during which trade secret information is discussed. Provides for future review and repeal. Effective June 1, 2005; became a law June 17, 2005; see 374 So. 2d 959 (Fla. 1979).

Ch. 2005-265 (C.S. for S.B. 938)  Specifies a patient’s right of access to adverse medical incident records; prescribes access procedures and fees; restricts use; defines specified terms. Effective June 20, 2005.

Ch. 2005-274 (H.B. 1019)  Creates the Asbestos and Silica Compensation Fairness Act; requires physical impairment as an essential element of the claim; prescribes prima facie evidentiary requirements, claim procedures, statute of limitations, and liability scope and rules. Effective July 1, 2005, and applicable to any civil action asserting an asbestos claim in which trial has not commenced as of July 1, 2005.

C.S. for S.J.R. 2144  Proposes an amendment to s. 19, Art. III of the State Constitution relating to state budget planning, spending, and accountability requirements. H.J.R. 1177  Proposes an amendment to s. 4, Art. VI of the State Constitution and creation of s. 26, Art. XII to change the term limits for certain elected constitutional officers from eight consecutive years to twelve consecutive years. To be submitted to the electorate for approval or rejection at the general election to be held in November 2006.

H.J.R. 1723  Proposes an amendment to s. 5, Art. XI of the State Constitution to require that any proposed amendment to or revision of the State Constitution be approved by at least 60 percent of the electors voting on the measure.
